Welcome to OM. These Terms of Service govern your use of pipelineom.com and all associated subdomains, including any waitlist submissions, early access applications, and pre-launch interactions with our platform.

Acceptance of Terms
By accessing pipelineom.com, submitting any form on our website, joining our waitlist, or engaging with any OM services or communications, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety.
Your continued use of our website and services constitutes ongoing acceptance of these Terms, including any modifications we may make from time to time. If you do not agree with any part of these Terms, you must immediately discontinue use of our website and services.
These Terms create a legally binding agreement between you (the "User") and OM (the "Company"). By proceeding, you confirm you have the legal capacity to enter into this agreement and are at least 18 years of age or the age of majority in your jurisdiction.
Early Access & Waitlist Program
Our early access program represents a carefully curated selection process designed to identify ideal partners for OM's launch phase. Participation in our waitlist provides you with the opportunity to be considered for exclusive early access to our platform and services.
No Guarantee of Access
Submission of a waitlist application does not guarantee acceptance into our early access program. Each application is reviewed individually, and selection is made at our sole and absolute discretion based on factors including but not limited to: alignment with our mission, potential partnership value, use case relevance, and program capacity constraints.
Selection Process
OM reserves the complete and unilateral right to select early access partners based on our internal criteria and business objectives. We may consider factors such as industry vertical, company size, technical requirements, strategic alignment, and timing. No applicant has any right or claim to early access.
Confidentiality Requirements
All information shared during briefings, demonstrations, onboarding sessions, or any communication related to OM's platform, features, roadmap, pricing, or business operations is considered strictly confidential and proprietary. You agree not to disclose, share, or discuss any such information with third parties without our express written consent.
Early access participants may be required to sign additional non-disclosure agreements (NDAs) or partnership agreements prior to receiving access to the platform. We may revoke early access at any time if confidentiality obligations are breached or if participation terms are violated.
Intellectual Property Rights
All content displayed on pipelineom.com and its subdomains, including but not limited to text, graphics, logos, icons, images, audio clips, video content, digital downloads, data compilations, software, design elements, and the overall "look and feel" of the website, is the exclusive property of OM and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
The "Become Intelligent" tagline, the OM name, logo, and all related marks, slogans, trade dress, and product names are registered and unregistered trademarks or service marks of OM. These marks may not be used in connection with any product or service that is not OM's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits OM.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use pipelineom.com strictly in accordance with these Terms. This license does not include any right to: reproduce, duplicate, copy, sell, resell, or exploit any portion of the site; use any data mining, robots, or similar data gathering and extraction tools; or create derivative works based on our content.

Limitation of Liability
This section outlines the boundaries of OM's legal responsibility and liability regarding your use of our website, waitlist program, and any related services. Please read carefully as it contains important limitations on our obligations.

As-Is Provision
The pipelineom.com website, waitlist service, and all related materials are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

No Product Warranties
We make absolutely no warranties, representations, or guarantees regarding future product features, functionality, performance, availability, release dates, pricing structures, service levels, or any other aspects of the OM platform that may be under development or discussion during the waitlist or early access phases.

Maximum Liability Cap
In no event shall OM, its officers, directors, employees, agents, or affiliates be liable to you for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages whatsoever, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

Important Notice: You acknowledge that OM is a pre-launch technology company and that all product information, features, capabilities, timelines, and other forward-looking statements are subject to change without notice. You agree to hold OM harmless from any claims arising from changes to product plans or specifications.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, OM's liability will be limited to the greatest extent permitted by law.
Governing Law & Dispute Resolution
Applicable Law
These Terms of Service and any disputes arising out of or related to these Terms, your use of pipelineom.com, or your relationship with OM shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
You agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or any transactions between you and OM.
Jurisdiction & Venue
You irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, for any legal action, suit, or proceeding arising out of or related to these Terms or your use of our services.
You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts, including any claim that San Francisco County, California is an inconvenient forum.

Informal Resolution
Prior to filing any legal action, you agree to first contact OM at hello@om.how to attempt to resolve the dispute informally.

Mandatory Arbitration
If informal resolution fails, disputes may be subject to binding arbitration in accordance with the American Arbitration Association rules.

Court Proceedings
Any arbitration award may be entered as a judgment in any court of competent jurisdiction in San Francisco, California.
Modifications & Updates to Terms
OM reserves the right to modify, amend, or update these Terms of Service at any time, in our sole discretion, to reflect changes in our business practices, legal requirements, platform features, or for any other reason we deem appropriate. Your continued use of our website following any such changes constitutes your acceptance of the new Terms.

What Constitutes Material Changes
Material changes include, but are not limited to: significant modifications to user rights or obligations; changes to limitation of liability provisions; alterations to dispute resolution procedures; modifications to intellectual property terms; changes to pricing structures (once applicable); or updates to data collection and privacy practices.
When we make material changes to these Terms, we will notify all active waitlist members via email at least thirty (30) days before the changes take effect. We will also update the "Last Updated" date at the top of these Terms.
For non-material changes, such as clarifications, formatting updates, or minor corrections, we may not provide individual notification but will update the "Last Updated" date and post the revised Terms on our website.

Your Responsibility: It is your responsibility to regularly review these Terms of Service. We recommend checking this page periodically for any changes. If you do not agree with any modifications, you must discontinue use of our services immediately.
